These Terms and Conditions govern the provision of all logistics, freight forwarding, and transportation services provided by TIN Services (hereinafter referred to as “the Carrier”, “We”, “Us”, or “Our”) to the client (hereinafter referred to as “the Consignor”, “the Customer”, or “You”). By booking our services, generating an Lorry Receipt (LR), or handing over goods to our fleet, you agree to be bound by these Terms.
Definitions
- Consignor: The person or business entity handing over the goods for transport.
- Consignee: The person or business entity to whom the goods are to be delivered.
- Goods/Cargo: The physical items accepted by the Carrier for transportation.
- Lorry Receipt (LR) / Consignment Note: The document issued by Us acknowledging receipt of the Goods for transport.
Scope of Services and Carrier Obligations We agree to transport the goods provided by the Consignor to the specified Consignee destination using appropriate vehicles and standard care. However, we reserve the right to refuse transport for any goods that are deemed unsafe, inadequately packaged, or illegal.
- Prohibited Goods: We strictly do not transport contraband, illegal narcotics, undocumented cash/bullion, highly explosive or hazardous materials (unless explicitly contracted with appropriate permits), or any goods prohibited by Indian law.
Consignor’s Responsibilities and Documentation The Consignor is entirely responsible for the accuracy of the cargo declaration.
- Packaging: Goods must be securely and adequately packaged to withstand the normal rigors of road transport. We are not liable for damage resulting from insufficient or defective packaging.
- Compliance & Documentation: The Consignor must provide all legally required documentation at the time of loading. This includes, but is not limited to, accurate Tax Invoices, Delivery Challans, and valid Part-A and Part-B E-Way Bills compliant with current GST regulations. Any delays, penalties, or seizures by tax authorities due to incorrect or missing documentation will be borne entirely by the Consignor.
Rates, Invoicing, and Payment Terms
- Freight Charges: Rates are calculated based on distance, weight, volume, and vehicle type as agreed upon in the quotation or contract.
- Payment: Unless a prior credit agreement is in place, payment is due upon booking.
- Taxes: All freight charges are exclusive of GST and other applicable government levies, which will be added to the final invoice as per prevailing rates.
- Right of Lien: TIN Services reserves a general lien on all Goods transported. If freight charges, demurrage, or other outstanding dues are not paid, we reserve the right to withhold delivery or ultimately dispose of the goods to recover the owed amounts, subject to legal notice.
6. Demurrage and Detention Charges Time is critical in logistics. If our vehicles are delayed at the loading (origin) or unloading (destination) points beyond the agreed free time, detention or demurrage charges will be levied at a rate as agreed upon oder booking until the vehicle is released.
Liability and Insurance
- Transit Insurance: TIN Services acts strictly as a carrier. We do not provide transit insurance for the goods. It is the sole responsibility of the Consignor or Consignee to adequately insure the goods against damage, theft, fire, or loss during transit.
- Limitation of Liability: Our liability for any loss or damage to the goods during transit is strictly limited to the provisions set forth in the Carriage by Road Act, 2007. We are not liable for any indirect, consequential, or unforeseen financial losses arising from delayed deliveries.
- Force Majeure: We are not liable for any delay, loss, or damage caused by circumstances beyond our reasonable control, including but not limited to acts of God, extreme weather, riots, strikes, highway blockades, government interventions, or natural disasters.
Claims and Disputes
- Notice of Claim: Any claim for shortage, damage, or loss must be noted in writing on the Delivery Challan/LR at the time of unloading. Written notice of a formal claim must be submitted to our office within 7 days of the delivery date.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
- Jurisdiction: Any legal disputes, claims, or proceedings arising out of these services shall be subject to the exclusive jurisdiction of the competent courts located in Jamshedpur, Jharkhand.
